Quick Answers to the Most Common Questions from the Planning & Zoning Department

SCHEDULING INSPECTIONS
Two types of inspections are necessary:

  • Zoning inspections by Hamburg Township regarding the meeting of requirements under the regulations of the Hamburg Township Zoning Ordinance. To schedule zoning (land use permit) inspections, call the Planning & Zoning Administration office at (810) 231-1000 Ext. 230, or send an e-mail to Ted Michowski at tmichowski@hamburg.mi.us. 
  • Building inspections by the Livingston County Building Department (517)-546-3240.

 

Ordinances
Hamburg Township has a number of ordinances and many of the provisions affect zoning issues and concerns.

  • Do I need a permit for my project? In almost all cases, you will need a Land Use Permit from Hamburg Township for the project you are planning. This includes building a shed, deck or garage and also applies to interior remodeling. View Land Use Permit Packet
  • What document must I submit to prove that I own the property on which I wish to obtain a permit to build a project? You must submit a copy of a warranty deed showing that you are the owner of your property with your other documents when applying for a land use permit. If you are a builder or other contractor applying for a permit on behalf of your client, you must obtain a copy of their warranty deed, and submit it when applying for a land use permit. Only a warranty deed will be accepted as proof of ownership.
  • What documents do I need to submit to apply for a Land Use Permit?  If your project is not listed below, assume a permit is still needed and call (810) 231-1000  EXT. 230, for additional information.
    • Addition: 3 sets of construction plans, 3 copies of a site plan showing location, setbacks from property lines, well location, septic or grinder pump location.
    • Deck: 3 sets of construction plans, 3 copies of a site plan showing setbacks from the property lines, well location, septic or grinder pump location.
    • Demolition of an existing structure: Proof of Ownership (Warranty Deed), notification letters from all utilities that service has been discontinued. If the structure was on septic field service, a receipt from the septage hauler that proves the septic tank was emptied. See Demolition Policies.
    • Fence: 2 copies of a site plan indicating the height of the fence and its placement on the property.  View Fences and Walls Handout.
    • Fill: (more than 90 cubic yards) 1 copy of a site plan showing where the fill will be placed.
    • Garage: 3 sets of construction plans, 3 copies of a site plan showing the location, setbacks from property lines, well location, septic field and tank/or grinder pump location.  View Accessory Structure Handout.

    • Shed (199 sq. feet or less): 2 sets of construction plans, 2 copies of a site plan showing setbacks from the property lines, well location, septic field and tank/or grinder pump location. Accessory Structure Handout.
    • Shed (over 200 sq. feet): 3 sets of construction plans, 3 copies of a site plan showing setbacks from the property lines, well location, septic field and tank/or grinder pump location. View Accessory Structure Handout.
    • Seawalls: A permit from the Michigan Department of Environmental Quality (MDEQ) is required before you will receive a Land Use Permit from Hamburg Township.
    • Hot Tubs: 3 sets of construction plans, 3 copies of a site plan showing setbacks from the property lines. You will also need to obtain Livingston County Building Department permits for hot tubs. View Accessory Structure Handout.
  • Horses: You need to have 2 acres for the first 2 horses, and 2 additional acres for each horse thereafter. In addition, the keeping of horses must an allowed use in the zoning district of the property.
  • Dog Kennels: A "dog kennel" shall be construed as an establishment wherein or whereon three (3) or more dogs are confined and kept for sale, boarding, breeding, training or sporting purposes, for remuneration.
  • Grading my property: A Land Use Permit will be needed from Hamburg Township and also soil erosion control permits from Livingston County Drain Commission (517)-546-0040.
  • Location of my well/septic tank: You will have to contact the Livingston County Health Department or call them at (517)-546-9850 for this information.
  • Floodplain: My mortgage company says that my property is in a floodplain. Where can find additional information? To view Flood Maps please go to the FEMA website here. Additional questions may be answered by contacting our Planning & Zoning Office at (810)-231-1000 Ext. 230.
  • Obtaining an address: You will be issued an address for a new home/business when the appropriate Land Use Permit is applied for and approved. No address is assigned to vacant lots of record.
  • Junk cars/Trash: If a property in your neighborhood has junk cars and/or trash sitting around, contact the Planning & Zoning Administrator/Code Enforcement Officer.
  • Interior Remodeling: Land Use Permits are required for any kind of interior remodeling, including, but not limited to moving walls, removing walls, adding walls, finished basement, changing ceiling height, roof trusses, helical piers, etc.
