
New Trial Date Set For Former Hamburg Twp. Trustee
11/17/09 - A new trial date has been
scheduled in the case against a Hamburg Township woman charged
with disturbing the peace, reckless driving and trying to
block traffic on Island Shore Drive. A mistrial was declared
due to a hung jury in October in the case against 57 year
old Mary Ann Lamkin. The trial lasted for eight days in front
of Livingston County Circuit Court Judge Michael Hatty but
after deliberations, the jury was deadlocked and unable to
get a unanimous vote. Although a settlement is unlikely in
the case, a potential deal could be worked out on January
8th. If not, a new trial will get underway on the 11th. Lamkin
was arrested on July 8th, 2008 after allegedly blocking the
road, refusing to move and yelling profanities at the Hamburg
Township Police Chief. Lamkin, a former Hamburg Township trustee,
has had numerous run-in’s with the law and the township
related to her attempts to block traffic trying to utilize
Island Shore Drive, which she claims is private property.
After years of litigation, a judge previously ruled that the
road is the only access road for area residents and that 16
feet of Island Shore Drive is an easement. But neighbors say
Lamkin erected steel poles on each side of the road, leaving
exactly 16 feet between them, which has proven too narrow
for passing cars. (JM)
