WHAT IS A SPECIAL ASSESSMENT DISTRICT (S.A.D.)?

S.A.D. General Information

 

Public Act 188 of 1954, as amended, is the most common Act used by Townships for the purpose of establishing road maintenance and road improvement projects. Under P.A. 188 a Township has the option of financing projects by selling bonds or by self-funding the project. Self-funding is usually done through a revolving fund, an enterprise fund or a special purpose fund. It is possible, however, to self-fund through the general fund for projects that benefit the entire community such as Township-wide trash hauling services.

 

If a project, such as a road improvement, must be funded through a bond sale the Township Board will need to adopt the following resolutions:

 

  1. Reimbursement Resolution
  2. Resolution Authorizing Publication of Notice of Intent to Issue Bonds for Road Improvements
  3. Resolution to Proceed with the Project and Directing Preparation of the Plans and Cost Estimates
  4. Resolution to Approve the Project, Scheduling the First Hearing and Directing the Issuance of Statutory Notices
  5. Resolution Approving Project, Cost Estimates, Special Assessment District and Causing the Special Assessment Roll to be Prepared
  6. Resolution Scheduling the Second Hearing and Directing the Issuance of Statutory Notice
  7. Resolution Confirming the Special Assessment Roll
  8. Bond Authorizing Resolution

 

NOTE: These Resolutions should be drafted by your Bond Attorney to ensure the proper legal language and statutory requirements have been included in the resolutions .

 

After Resolution #8 is adopted the Township Board, with the assistance of their financial advisor and bond attorney, will need to :

 

  1. Confirm Qualified Status with Department of Treasury
  2. Prepare and Publish Preliminary Official Statement
  3. Prepare and Publish Official Notice of Sale
  4. Conduct Bond Sale
  5. Authorized Officer signs Award Certificate for the Bond Sale
  6. Publish Final Official Statement
  7. Closing on Bond Issue and Receipt of Bond Proceeds
  8. Begin Construction on the Project
