WHAT IS A SPECIAL ASSESSMENT DISTRICT (S.A.D.)?
S.A.D. General Information
Public Act 188 of 1954, as amended, is the most common Act used by Townships for the purpose of establishing road maintenance and road improvement projects. Under P.A. 188 a Township has the option of financing projects by selling bonds or by self-funding the project. Self-funding is usually done through a revolving fund, an enterprise fund or a special purpose fund. It is possible, however, to self-fund through the general fund for projects that benefit the entire community such as Township-wide trash hauling services.
If a project, such as a road improvement, must be funded through a bond sale the Township Board will need to adopt the following resolutions:
NOTE: These Resolutions should be drafted by your Bond Attorney to ensure the proper legal language and statutory requirements have been included in the resolutions .
After Resolution #8 is adopted the Township Board, with the assistance of their financial advisor and bond attorney, will need to :
